Please read carefully all the following Refunds Policy before using our website and Services, because they constitute a binding agreement between you, the individual or legal entity.
TERMS AND DEFINITIONS
Bank - a credit or financial institution that is a member of the International Payment System (IPS) and that provides services for the processing of Transactions, Refunds and Chargebacks.
Cardholder means an individual in whose name the Card was issued purchasing Goods from the Merchant by using the Card.
Card (Payment Card) means any payment card or virtual payment card of the Payment Schemes as a non-cash payment instrument intended for the Cardholder to carry out transactions with funds.
Card issuer - a credit organization or a legal entity that issued (issuing) the Card.
Customer - means an individual who buys or has bought goods and/or services of the Merchant.
Goods mean goods, services, results of intellectual activities, and other types of objects of civil law rights. IT Protocol means a technical integration protocol implemented by the Parties.
Merchant – legal entity or self-employed person, selling their Goods through the Internet.
Partner - any individual or legal entity with which the PS enters into business relations both on the basis of an agreement and due to actual circumstances (including, but not limited to, under the Accession Agreement on the PS website).
Personal Account - a section on the PS Website, protected by an access control system, providing current information on Funds Transfers, remuneration, technical status of connection to the PS system, the ability to receive statistical data on Funds Transfers in favor of the Merchant and other information necessary for the current use by the Merchant PS systems. The personal account is located at the following address: https://1payment.com Payment Methods - how the Merchant can receive Payments from Clients, incl. from Cardholders.
Payment System (hereinafter abbreviated as PS) - 1Payment.
PS Website - means the PS Website available at https://1payment.com is owned and operated by 1Payment.
Party (Parties) - PS and the Merchant, when together referred.
Refund - the procedure by which the Merchant requests the refund of the Transaction Amount or part of the Transaction Amount to the Cardholder.
Settlement Participants - the Client, Settlement Systems, Issuer, Bank, PS, Merchant, when together referred.
Transaction - a payment sent by the Client to the Merchant using the Client's Bank Card through the website (online store) of the Merchant or its mobile application. Other specific terms and abbreviations used in the text of this Policy are used in accordance with the meaning set forth in the Accession Agreement posted on the PS website, and in their absence in the specified agreement, in accordance with the meaning adopted in international or national legislation.
I. General terms and conditions
1.1. This Policy of refunds (hereinafter referred to as the Policy) determines the PS policy for making refunds to the Customer, and also regulates the rights and obligations of the Parties in the process of making Refund Transactions.
1.2. This Policy is mandatory for all Counterparties using the services of the PS, incl. under the Accession Agreement posted on the PS website. Acceptance of the terms of the Accession Agreement and (or) the beginning of the use of PS services means automatic acceptance of this Procedure.

The Policy is valid indefinitely until it is replaced by a new version.
1.4. The Policy may be amended at any time, the current version is posted on the website of the PS. The new version will be valid from the moment it is published on the PS website.
1.5. We can terminate these Terms of Use and/or suspend or terminate your rights to use our services, with or without cause at any time, at our sole discretion and without prior notice and effective immediately.
II. PROCEDURE AND TERMS OF REFUND
2.1. The Merchant has the right to carry out the Refund to the Customer in the following ways:
2.1.1. Using the «REFUND» function. In this case, the Refund Transaction is carried out on the basis of a Request for the Refund Transaction (hereinafter referred to as the «Request») at the expense of the funds to be transferred. The procedure for the Refund Transaction using the «REFUND» Function, as well as the procedure for compiling and submitting the Request to the PS by the Merchant is set out in Section 3 of the Policy.
2.1.2. Directly to the Client without participation of PS. In this case, the return of funds to the Customer under the Refund Transaction is carried out by the Merchant independently (without the participation of the PS, and other Participants) in the manner specified in the agreement concluded between the Merchant and the Customer taking into account the requirements established by the current legislation of the country of the Merchant or the Customer. The procedure for the refund of funds by the Merchant to the Customer under the Refund Transaction without the participation of the PS is not the subject of the Agreement and is not established by this Policy.
2.2. The refund does not entail obligations for the PS to return to the Merchant the commission for the provision of PS services paid by the Merchant in accordance with the Tariffs established by the PS.
2.3. Settlements with the Issuer under the Refund Transaction are carried out by the Bank on the basis of information and data provided by the PS. The procedure and terms for the Bank to make settlements under the Refund Transaction (transfer of funds to the Issuer) are not the subject of the Agreement and are not regulated by this Policy.
2.4. The Bank does not transfer funds under the Refund Transaction on the basis of the transfer order of the Merchant. When the Bank receives the amount of funds from the Merchant's bank account for the purpose of carrying out the Refund Transaction, such amount of funds is returned by the Bank to the Merchant within 5 (five) business days from the date of its transfer to the Bank's correspondent account using the Merchant's details specified in the transfer order.
III. REFUND CONDITIONS
3.1. The Merchant has the right to conduct the Refund Transaction using the «REFUND» Function, subject to Full activation in the Personal Account and in the PS system and the transfer amount is sufficient for the Refund Transaction, taking into account the commission, in full force.
3.2. To use the "REFUND" Function, the Merchant is obliged to send a Request to the PS via the Personal Account or IT protocol.
3.3. The Request have to contain:
• The Payment Method to return funds under the Refund Transaction;
• the identification number of the payment in the PS system, the Customer's payment details, the amount and date of payment for which the Refund Transaction is carried out;
• the reason for the Refund.
3.4. Upon receipt of the Request from the Merchant, the PS checks the sufficiency of the amount of the Transfer to carry out the Refund Operation in the amount specified in the Request.
3.5. If the amount of the transfer is sufficient to carry out the Refund Transaction in the amount specified in the Request, the PS, if technically possible, provides the Issuer with information on the implementation of the Refund Transaction through the system. If there are enough amounts for the Refund in the amount specified in the Request, then the PS, if technically possible, provides through the system the transmission of information on the implementation of the Refund Transaction to the Issuer. At which time:
3.5.1. If the PS received information from the Issuer about the impossibility for the Refund Transaction to the Payment Method in accordance with the Request, as well as if the PS is not technically capable of transmitting information to the Issuer about the implementation of the Refund Transaction through the system: • the request for execution of the PS is not accepted, the Refund operation is not carried out; • information about the impossibility the Return Operation is posted by the PS in the Personal Account; • The Merchant obliged to adjust on a stand-alone basis all arising complaints with the Payer (Customer).
3.5.2. If the SP received information from the Issuer about the possibility of making a refund to the Payment Method in accordance with the Request: • the request is considered accepted by the PS on the first business day following the day of receipt from the Issuer of information about the possibility to carry out the Refund Transaction to the Payment Method; • The PS, no later than 3 (three) working days from the date of receipt of the Refund Request, offsets the amount of the Transfer against the amount of the Refund Transaction in the manner prescribed in the Agreement between the PS and the Merchant (including the Agreement of Accession posted on the website of the PS). • Information about the execution of the Request is notify to the Merchant by PS through the Personal Account by sending a message.
3.6. In the event that on the date of receipt of the Request by the PS in accordance with clause 3.4 of the Policy, or on the date of receipt from the Issuer of the information specified in clause 3.5.2 of the Policy, the amount of the Transfer is not enough to carry out the Refund Operation in full, the Refund Operation is not carried out. Information about the impossibility to carry out the Return Operation is notifying to the attention of the Merchant by PS through the Personal Account by sending a message.
3.7. In the event, that the Issuer did not accept the funds under the Refund Transaction for crediting to the Payment instrument specified by the Merchant in the Request, the Bank, based on the information and data provided by the PS, refunds the funds to the Merchant using the Merchant's details specified in the Personal Account or IT- protocol.
